Home improvement contract had list of desired improvements. One was never completed and now we have problems with a window they put in less than one year ago due in part to faulta installation. Window manuf. is bankrupt and contractor will not replace. So one of the items they were supposed to do they did not. So does that constitute breach of contract and if so will that breach allow me to ignore the arbitration agreement on that contract and use small claims instead?

Yes, if they charged you for certain items and didn’t complete them, that’s a breach. If they did work negligently, that’s a breach. If they installed a window which was defectively manufactured, that is probably not a breach. No, a breach does not allow you to ignore the arbitration clause.

Good luck to you,

I’m thinking of renovating my house and am wondering what would be my best option to gain funds to do the work.My mortgage company do advances on mortgage that you pay off over the remaining time that would be twenty years.Would it be a good idea to do this or would I be better getting a separate home improvement loan from another company.

Do you need the space? If not, hold off. You don’t want to take on additional debt at this point if you can avoid it. If you have to renovate because you really need the space, or to fix problems with the basement, then your best bet is to put your savings in a CD and get a secured loan (lowest interest rate, easiest loan to obtain now). Or get a second loan for a much shorter term than re-jiggering the mortgage for a 20-year term. That, too, will cost you less in the long run. For such a small amount, you probably shouldn’t go more than 3 – 5 years.

I want to start a home improvement company. Please give me necessary information about licensing.

It really depends where you are located what licensing you will need.

You will at least likely need business licences, and maybe contractors licenses. Don’t forget liability insurance.

Some trades require their own licensing, such as electric, plumbing, HVAC (at least to deal with gas, combustion exhaust, and A/C refrigerant). Masonry might need a license.

I live in a duplex and the people on the other side are in the middle of some major home improvement escapade.

They’re hammering and sawing and apparently ripping the floor up. They’ve been doing this ALL day and they aren’t showing any signs of stopping…in fact, their friends just came over to help.

I don’t wanna be rude, but I have to get up at 6 AM and I kinda need to sleep. Would it be really rude of me to go over and ask them to stop?

Normally they should finish by 8 pm.. and then resume their work the next day.. Yes you can ask them in a friendly way.. that you understand they want to get their apartment nice.. but if they still hammer at 10 pm.. that is rude.. I would not tell them that it’s rude but I would say.. that you have to be up at 6 AM and would like some undisturbed sleep.. if you go to bed at 10 pm then you get your 8 hrs of sleep.. it’s the same with music.. they can turn it up more but at 10 pm it has to be at room noise level… so I would talk to them.. maybe they are so enthusiastic about what they are doing they don’t know the time… xxx
